This CLE will discuss the jurisprudential background that underpins the constitutional history and interpretation of the 14th Amendment, in particular how constitutionalism has impacted how it has developed over the last 100+ years. At the very heart of our constitutional system, the 14th Amendment has a number of crucial roles to play in our modern understanding of our society, and this CLE will briefly explore where that comes from and where we can see that going in the near future.
