On July 16, the FCBA Criminal Practice Committee will hold a Zoom CLE on asset forfeiture and restitution, combined with criminal practitioner happy hours in Albany and Syracuse (5:00 pm).
Course Summary: Attendees will gain a practical understanding of how the U.S. Attorney’s Office approaches restitution, as well as administrative and judicial forfeiture, in criminal cases.
Panelists: Panelists will include Assistant U.S. Attorneys Tamara Thomson and Melissa Rothbart of the U.S. Attorney’s Office. Panelists will also include representatives from the U.S. Marshals Service and the U.S. Probation Office.

Detailed Agenda:
- Overview of how the U.S. Attorney’s Office approaches restitution, as well as administrative and judicial forfeiture, in criminal cases.
- Defendant’s Obligations Prior to Sentencing
– Submission of a Financial Statement to the U.S. Attorney’s Office and to Probation
– Information to be included in a Presentence Investigation Report - Former Defendant’s Financial Obligations During Probation or Supervised Release
– Financial reporting to Probation
– Fulfillment of obligation to pay restitution
– Fulfillment of obligation to pay asset forfeiture money judgment - Q&A with questions preferably submitted in advance
The NDNY FCBA has been certified by the New York State Continuing Legal Education Board as an Accredited Provider of continuing legal education in the State of New York. “Asset Forfeiture and Restitution in NDNY Criminal Cases: What You Should Know” has been approved in accordance with the requirements of the New York State Continuing Legal Education Board for 1.5 Credits in Professional Practice.
